Sumaq Editor: End User License Agreement

By purchasing or using Sumaq, you agree to the following terms.

1. License Grant

For paid use we offer two licenses:

The Single license grants the right to use Sumaq for one person, one workstation, or one specific project. It is limited to that single use and cannot be extended to additional people, workstations, or projects.
The Pro license is per company and grants the right to use Sumaq in unlimited projects, including personal and client work.

Both licenses are purchased per major version (see section 2). Free licenses are covered in section 5.

2. Version Scope

Each license covers one major version of Sumaq (e.g., version 1.x) and includes all minor and patch updates within that major version. Upgrading to a new major version (e.g., from 1.x to 2.x) requires a new license purchase.

3. Source Code

The full source code is included with your purchase. You may read, audit, and extend it for your own use. You may not redistribute, sublicense, or resell the source code (in whole or in part) to third parties.

4. Restrictions

You may not redistribute the source code or compiled versions of Sumaq.
You may not sublicense or resell Sumaq.
You may not remove or alter copyright or license notices included in the source.

5. Free Licenses

We offer free licenses to people and organizations for whom the license fee is a barrier. No proof required. We trust you.

To apply, fill out the free license form. You select a category, provide your name and email, and that's it. An optional message field is there if you want to tell us something, not because you have to justify yourself.

Categories: nonprofit organization, educational institution, student, individual facing financial hardship, non-commercial or personal use.

6. Warranty and Liability

Sumaq is provided with the functionality agreed at the time of delivery. We do not assure suitability for any purpose beyond the agreed specification, nor uninterrupted or entirely error-free operation.

We are liable without limitation

for intent and gross negligence,
for culpable injury to life, body, or health,
under the German Product Liability Act (Produkthaftungsgesetz), and
to the extent of a guarantee we have assumed or of fraudulently concealed defects.

For ordinary negligence, we are liable only for the breach of an essential contractual obligation (a "cardinal duty"), i.e., an obligation whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In that case liability is limited to the foreseeable damage typical for this type of contract. Otherwise our liability is excluded.

The above limitations also apply in favor of our legal representatives, employees, and vicarious agents. Your statutory warranty and consumer rights remain unaffected.

7. Termination

This license is effective until terminated. It terminates automatically if you violate any of its terms. Upon termination, you must stop using Sumaq and delete all copies of the source code.
